CIVIL DISTURBANCE
 

A thorough understanding of police procedures will be required before specific personnel assignments are written into the Emergency Action Plan. The activities of school personnel must be such that they do not interfere with or hinder police officers in carrying out their duties. Depending on the intensity of the disturbance, police may wish to simply advise and assist school personnel, or they may require the services of school personnel in identifying those persons who are causing or encouraging the disturbance.

RESPONSIBILITY

A. 

Civil Disturbance
 

1.

In the event of a civil disturbance or impending disturbance, the school principal will immediately notify the District administration and the Police Department.

2.

Under the direction of the principal, faculty members will surround the participating students, if possible, to prevent others from joining in the disturbance and to confine the disturbance in one area.

3.

The school office manager will turn off the bell system to prevent students from automatically leaving one classroom to go to another.

4.

Teachers will keep students in their classroom until notified that the disturbance has been controlled.

5.

Teachers who have free periods will report the principal's office for assignment of specific duties.

6.

Notify students via bullhorn, public address system or other appropriate means, in the presence of adult witnesses, to end the disorder by returning to assigned classes.

a.

Students should be warned:
 

1)

that by not going to classes they risk suspension and/or arrest; and

2)

that individuals who violate school policy by encouraging illegal demonstrations by fellow students may be immediately suspended from school.
 

b.

Staff members should be assigned responsibility of verifying the audibility of all announcements (tape record, if possible).
 

c.

Non-Claremont Unified School District students will be asked to leave the campus immediately.
 

7.

If a pupil persists in the disruptive activity following a second warning and after a reasonable time (2-3 minutes) notify the student of his/her suspension.

8.

If students continue their disruptive activity after notification of their suspension, the principal may proceed with their arrest under the provisions of Section 626.8, California Penal Code, and Section 3221, California Education Code.

9.

Leaders of illegal demonstrations, either active in addressing the group or restraining the voluntary actions of any individual who wishes to return to class, should be addressed by name and told that if he/she persists in their actions, they may be immediately suspended from school.

Students who are on the fringes of the demonstration (on-lookers) who do not honor the dispersal request may be suspended from school and removed from the school property.

11.

School personnel will not enter the group or take any action that will provoke violence.

12.

Faculty members will escort students to their proper locations in the building, if necessary, to avoid disturbance in other areas of the building or to prevent such students from returning to the disturbance.

13.

The school principal will determine which doors will be locked to contain the disturbance. Exits will be designated and a staff member stationed at such exits.

14.

Custodians/Proctors will lock all but one boy's and one girl's restroom. Those two restrooms will remain under the supervision of the Custodians/Proctors.

B.

Employee Disturbance
 

1.

If the disturbance occurs during assigned work hours after the employee has reported for work, adopt the following procedure in the presence of an adult witness:

a.

Request that employee(s) desist from their participation and return to their assignment.

b.

If, after a reasonable time (2-3 minutes), the employee refuses to comply with the request, direct employee to the school or Superintendent's office.

c.

If, after a reasonable time (2-3 minutes), the employee has not complied with the request, notify him that he is guilty of insubordination and that he is subject to arrest in accordance with Section 626.8, California Penal Code, and Section 32211, California Education Code. If his presence continues to disrupt the activity of the school, proceed to cause the arrest to be made by police.
 

2.

School employees who have not reported for duty but take part in disruptive activity are considered acting as independent citizens and are subject to procedures described below.
 

C.

General Public Disturbance
 

1.

If conduct of an adult who is not an employee of the District but whose conduct on school premises or adjacent territory interferes with the orderly processes of the school, warn him in the presence of an adult witness, that he is subject to arrest.

If, after a reasonable time (2-3 minutes), the adult has not complied with the request to desist, proceed to cause arrest.

D.

Use of Law Enforcement Agency
 

1.

If the disorder is beyond the capacity of the administration to control, call the Police Department.

Provide school resources to Police Department if requested.

3.

Staff should recognize that the law enforcement agency will be in charge when it responds to a call for assistance.

E.

Closing a School
 

1.

Should be considered only when all other alternatives have failed.
 

2.

Secure permission from Superintendent and if closing is approved:

a.

Notify school staff;

b.

Notify Police Department

c.

Make sure only necessary exits are open;

d.

Instruct staff to supervise pupils who are not released;

e.

During school hours, release students only to parents or authorized adults; and

f.

Remain on premises until safety of all pupils is assured.
